1. Acceptance

By accessing orcaweb3.io you agree to these terms. If you do not agree, stop using the site. The version published here on the date of your visit is the one that applies. These terms govern use of the website only. Client engagements are governed by a separate signed agreement, and where that agreement conflicts with this page, the agreement wins.

2. Nothing here is advice, and we are not selling you an asset

Nothing on this website is financial, investment, tax, accounting or legal advice. Nothing here is a recommendation, endorsement, offer or solicitation to buy, sell or hold any digital asset, token, NFT or security, and nothing here should be relied on in making any financial decision.

Orca Web3 does not offer, sell, distribute, underwrite, promote for investment purposes or endorse any digital asset. We do not operate an exchange, a market making desk or a treasury service. We do not publish price targets, forecasts, valuations or return expectations, and we will not do so on request. Where a chain, protocol, token, exchange or project is named anywhere on this site, it is named descriptively, to indicate the networks and ecosystems we work in and the kind of work we do. It is not an assessment of that project's merit, prospects or safety.

We provide branding, marketing, content and front end build services. We do not write, deploy or audit smart contracts, we do not conduct security reviews, and no material produced by us should ever be treated as a substitute for an audit or for professional advice from a qualified adviser in your jurisdiction.

3. Risk disclosure

Digital assets are volatile and speculative. Prices can move violently in either direction and total loss of capital is possible. Liquidity can disappear. Smart contracts can contain defects and be exploited. Custody can fail. Regulatory treatment differs between jurisdictions and changes, sometimes with immediate effect. If you transact in digital assets you do so at your own risk and on your own judgment.

4. No client relationship is formed by using this site

Browsing this site, reading anything on it, or submitting the enquiry form does not create a client, advisory, agency or fiduciary relationship between you and Orca Web3. We become your agency only when both parties sign an engagement agreement. Until then, please do not send us confidential information, and do not act in reliance on anything published here.

5. Intellectual property

The content of this site, including text, layout, design, graphics, code, imagery and the Orca name and marks, belongs to Orca Agency or its licensors and is protected by copyright and trademark law. You may view the site and quote short extracts with attribution and a link. You may not copy, republish, adapt, resell or systematically extract any substantial part of it without written permission.

6. Third party trademarks

Chain names, protocol names, exchange names, product names and their logos are the trademarks of their respective owners. Where they appear on this site they appear nominatively, to indicate the networks and ecosystems in which we work. Their presence does not imply endorsement, sponsorship, partnership, affiliation or any commercial relationship between those owners and Orca Web3, in either direction. We are not on any foundation's payroll and no chain pays for placement here.

7. Links to other sites

This site links to third party websites, including our sibling divisions and external news sources. We do not control those sites, we do not endorse their content, and we are not responsible for what they publish or collect. Following an external link is your decision, and their terms and privacy policies apply once you arrive.

8. Your conduct

When using this site you agree not to: scrape, crawl, harvest or systematically copy the site or its content to build, train or supply a competing service; attempt to gain unauthorised access to any part of the site or its infrastructure; probe, scan, overload or otherwise interfere with the availability or integrity of the site; submit malicious code; impersonate another person or organization; or submit another individual's personal data through our form without their knowledge and permission. You are responsible for anything you send us through the form.

9. Accuracy, and the news desk

We try to keep this site accurate and current, but content is provided for general information and may be incomplete, out of date or wrong. We may change or remove anything at any time without notice.

The news desk aggregates headlines and summaries from third party public feeds. We do not write those headlines, we do not verify them, and we do not endorse the outlets that publish them. Aggregated headlines, and any market data, prices or percentage moves displayed anywhere on this site, are provided as is, for information only. They may be delayed, cached, mispriced, mislabeled or simply incorrect. Never make a decision that costs you money based on a number you read on an agency website.

10. Impersonation and phishing

Read this one twice. We will never message you first about an investment opportunity, a token allocation, an airdrop or a presale. We will never ask you for a seed phrase, a recovery phrase, a private key or a wallet signature, and we will never ask you to connect a wallet in order to speak with us. We do not run token sales and we do not have a token.

Our only website is orcaweb3.io. Any other domain, lookalike spelling, Telegram group, Discord server or social account claiming to be Orca Web3 and asking you for funds, keys or signatures is fraudulent. If something reaches you claiming to be us, verify it through the form at orcaweb3.io/contact before you act on it.

11. Disclaimer of warranties

The site is provided on an as is and as available basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non infringement, and any warranty that the site will be uninterrupted, error free, secure, or that any content on it is accurate or complete.

12. Limitation of liability

To the fullest extent permitted by law, Orca Web3, Orca Agency, their divisions, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost opportunity, trading losses or loss of digital assets, arising out of or connected with your use of this site or reliance on anything published on it. Nothing in these terms excludes liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify and hold harmless Orca Web3 and Orca Agency from any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the site, or your submission of content or personal data you had no right to submit.

14. Governing law

These terms are governed by the laws of the United States and of the state in which Orca Agency is established, without regard to conflict of law principles, and the courts of that state have exclusive jurisdiction over any dispute arising from them.

15. Severability and waiver

We may revise these terms at any time by updating this page and its effective date. Continued use of the site after a revision means you accept the revised terms.
